General

All materials, images, trademarks and brands displayed published on this website are owned or controlled by Transylvania Holidays. Copying or storing of any content for other than personal use is expressly prohibited without prior written permission from Transylvania Holidays. Transylvania Holidays may from time to time change, alter, adapt, add or remove portions of these Terms & Conditions, but if does so, it will notify any such changes on this website. By accessing this website you agree that Transylvania Holidays will not be liable for any direct, indirect or consequential loss arising from the use of the information and material contained in this website. Although Transylvania Holidays makes every effort to ensure the accuracy of the website information and pricing, regrettably errors do occasionally occur. You must therefore ensure you check the price and all other details of your chosen arrangements with us at the time of booking.

Booking

When a booking is made, the 'lead name' on the booking guarantees that he or she has the authority to accept and does accept the terms of these booking conditions. After we receive your booking request and all appropriate payments, we will issue a confirmation invoice. A binding agreement will come into existence between us when we dispatch this invoice to the 'lead name'. In order to confirm your booking, you must pay a deposit, which will be confirmed to you at time of booking. If the booking is made within 70 days of departure full payment will be required by credit card or debit card. The balance of the cost of your booking is due not less than 70 days prior to departure. If we do not receive this balance in full and on time, we reserve the right to treat your booking as “cancelled” by you in which case the deposit fee will be non-refundable. If you do not supply the correct credit or debit card billing address and/or cardholder information, the issue of your confirmation invoice may be delayed. We reserve the right to cancel your holiday if payment is declined, or if you have supplied incorrect credit card information.

Transylvania Holidays endeavour to ensure that the most up to date and correct prices are shown on our website. Transylvania Holidays reserves the right to raise or lower their prices at any time. If the tour price will change after you confirm your booking, we will not alter your tour price. If an incorrect price may be shown due to an error we will endeavour to notify you as soon as reasonably possible. In this case, we reserve the right to cancel the booking if you do not wish to accept the price which is actually applicable to the Tour.

Where applicable, if the minimum number of clients required for a particular tour is not reached, we reserve the right to cancel your booking in which case a full refund will be issued. However, we will not cancel your travel arrangements less than 8 weeks before your departure date, except for reasons of force majeure, inadequate insurance cover, or failure by you to pay the final balance. Note that if you are making your own flight arrangements we cannot be held responsible for any non-refundable costs you incur through booking your own flights nor otherwise should we be forced to cancel your trip.

Changes

If, after our confirmation invoice has been issued, you wish to change your travel arrangements in any way, for example your chosen departure date or the tour package, we will do our utmost to make these changes but it may not always be possible. Any request for changes to be made must be made in writing via email from the person who made the booking. You will be asked to pay an administration charge of GBP 50 and any further cost we incur in making this alteration.

Cancellation

You, or any member of your party, may cancel your travel arrangements at any time. Cancellation charges as shown below will be applicable.

  • More than 70 days before departure:   Deposit
  • 70-30 days before departure:               50% of total trip cost
  • Less than 30 days before departure:   100% of total trip cost

If the reason for your cancellation is covered under the terms of your insurance policy,  you may be able to reclaim these charges via your insurance.

It is your responsibility to ensure that you are in possession of all necessary travel and health documents before departure. A full and valid passport is required for destinations we feature (including children). Visas may be required (if you are not a European citizen), so you must check passport and visa requirements with the Romanian Consulate or Embassy, prior to booking. If you do not supply the appropriate and correct information when you make your booking, we will not be able to make the necessary bookings on your behalf and cannot be held responsible. We consider adequate travel insurance to be essential. It is your responsibility to ensure that the insurance covers you and is suitable and adequate for your particular needs.

When you book a Holiday with Transylvania Holidays you accept responsibility for the proper conduct for yourself and your party whilst on the Tour. If we or any other person in authority is of the reasonable opinion that you or any member of your party is behaving in such a way as to cause or be likely to cause danger or upset to any other person or damage to property, we will be entitled to terminate the holiday of the person(s) concerned. The person(s) concerned will be required to leave the accommodation or other service and we will have no further responsibility to them including any return travel arrangements. No refunds will be made and we will not pay any expenses or costs incurred as a result of the termination. You will be responsible for making full payment for any damage or loss caused by you or any member of your party during your time away. Payment must be paid direct at the time to the service supplier concerned failing which, you will be responsible for meeting any claims subsequently made against us (together with our own and the other party’s full legal costs) as a result of your actions.

All baggage and personal property, including sporting equipment, are at all times at your own risk. We will not be responsible for any loss, damage or accident to any baggage, sporting equipment, money, or travel documents. You are advised to check the limitations of your insurance policy in this respect.

You must ensure that you are mentally and physically capable of undertaking your chosen Tour. By booking a Tour you accept any potential risks and hazards. You must tell us if you have an existing medical condition or disability before you book your Tour. If, in our reasonable opinion, your chosen Tour is not suitable for your medical condition or disability we reserve the right to refuse your booking. We reserve the right to cancel the contract if medical problems are discovered and, in this eventuality, we will give a full refund, but no compensation.

You are responsible for bringing with you the proper clothing and equipment, which we advise you about in our pre-departure information pack. If you are unable, or choose not to complete an itinerary outlined for a Tour, Transylvania Holidays is not liable to supply alternative services or a refund. In case of unpredictable factors such as weather conditions, we may need to change the itinerary. Should this happen the tour leader will consult the group before making any changes that are necessary. Of course we will always do everything within our powers to minimize the effects of the enforced changes. We cannot be held responsible for the results of changes or delays, irrespective of how they are caused.

In the unlikely event that you have any reason to complain or experience any problems with your holiday arrangements whilst away, you must inform your tour leader who will endeavor to assist you. If your complaint is not resolved locally, please email your complaint within 30 days of your return. We will investigate and deal with your complaint within 28 days after receiving your email.

Data Privacy Policy

At Transylvania Holidays we understand and respect the importance of your privacy and we are committed to safeguarding your personal information. This Privacy Policy describes how we work to maintain that trust you have in us and protect that information.

In order to respond to an inquiry, process and fulfill your booking or send you a brochure or other promotional material, we need to collect personal data from you. When we refer to personal data, we mean any information which relates to an identified or identifiable individual.

You may provide personal data to us in various ways. This may be provided over the telephone, online through our website or in emails to us.

Collection of information

Depending on what's required, the personal data we collect may include names, date of birth and contact details (such as telephone numbers, postal and e-mail addresses) and credit/ debit card or other payment information. It may also include information relating to any disability or medical condition which may affect travel arrangements and dietary restrictions which may disclose your religious beliefs. You are under no obligation to provide this information, however, in some cases, we are not able to guarantee to provide you with a suitably personalized service without this information. We do not ask you to send us or disclose any sensitive personal information relating to racial or ethnic origin, political opinion, religion or other beliefs, criminal background or trade union membership.

Please do not provide your personal data to us if you are not happy for us to process this information in accordance with this privacy policy.

With whom do we share your personal data?

Where you make a booking or booking enquiry, appropriate personal data will be passed on to the relevant suppliers (such as hotels, car hire companies etc) and any other third party (such as banks and/or credit card companies) who need this information so that your chosen arrangements can be booked and provided or your booking enquiry answered. Once your booking has been made, your personal data may also be provided to government/public authorities such as customs or immigration if required by them, or as required by law. Certain information may also be passed on to security or credit checking companies. We may also make personal data available to companies who provide services on our behalfs, such as mailing brochures and marketing material.

We only provide third parties with the personal data they require in order to deliver their services. Other than in relation to government / public authorities (over whom we have no control), we will take appropriate steps which are intended to ensure that anyone to whom we pass your personal data for any reason agrees to keep it secure, only uses it for the purpose of providing their services and does not collect any personal data from you in the course of performing their services. If we cannot pass personal data to the relevant suppliers or any other third party as applicable, whether in the EEA or not, we will be unable to fulfill your booking. In making your booking, you consent to your personal data being passed on to the relevant suppliers and other third parties.

Security of personal information

We take appropriate technical and organisational measures to protect against unauthorised or unlawful processing of personal data and against accidental loss or destruction of, or damage to, personal data, which is appropriate to the harm that might result from the unauthorised or unlawful processing or accidental loss, destruction or damage and the nature of the data to be protected, having regard to the state of technological development and the cost of implementing any measures.

All of our users' information is restricted in our offices. Only employees who need the information to perform a specific job (for example, our accounting staff or a customer service representative) are granted access to personally identifiable information.

We will only retain and use your personal data for marketing purposes where you have specifically consented to our doing so. You may provide your consent by opting to receive marketing material either online or by telephone. You may also choose in what ways you are happy to receive communications from us.

Accessing your personal information

You are entitled to ask us (by letter or e-mail) what personal data of yours is being held or processed, for what purpose and to whom it may be or has been disclosed. No fee will be charged for responding to this request unless it is obviously unfounded or excessive or we have previously provided the same information. We promise to respond to your request without delay and in any event within one month unless the request is complex or you have made numerous requests in which case we may be able to extend our response time by a further two months.

Updates & Changes

From time to time we may need to make changes to this privacy policy. These may be required as a result of changes in data protection laws or in the guidance issued by regulators such as the Information Commissioner's Office (which is usually referred to as the ICO) or where we make changes to our procedures.
